PROTECTION OF PERSONAL DATA ACCORDING TO THE GDPR

In application of current regulations regarding the protection of personal data, Agrometodos, S.A. hereby indicates that the personal data collected from the forms from the website: www.agrometodos.com is included in the automated files specifically for users of Agrometodos, S.A. services.

The purpose of collection and automated processing of the personal data is to maintain the business relationship and to perform information, training and advisory tasks and other activities inherent to Agrometodos, S.A.

This data will only be transferred to the necessary entities for the sole purpose of fulfilling the aforementioned purpose.

Agrometodos, S.A. takes the necessary measures to guarantee the security, integrity and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, a repealing the former LOPD, the new Organic Law 3/2018 of 5 December on the Protection of Data and Guarantee of Digital Rights (LOPDGDD).

Agrometodos, S.A. will process the personal data obtained on the website www.agrometodos.com for the following purposes:

1. To send commercial information and newsletters on new services offered on the website and in the sector.
2. To send promotional information by e-mail.
3. To provide the information requested by the user on the contact form.

Intellectual property rights www.agrometodos.com

Agrometodos, S.A. is the holder of all copyrights, intellectual and industrial property rights, know how, and any other rights related with the content of the website www.agrometodos.com and the services offered on it, as well as of the software necessary for its implementation and related information.

Any reproduction, publication and/or use that is not strictly private of the content, in whole or in part, of the website www.agrometodos.com is not permitted without prior, written consent.

Intellectual property of the software

The user must respect the third-party software provided by Agrometodos, S.A., even where it is free of charge and/or available to the public.

Agrometodos, S.A. holds the necessary user and intellectual property rights for the software.

The user acquires no right or licence through the service contracted, on the necessary software to provide the service or on the technical information to track the service, except for the rights and licences required to perform the services contracted and only while they are underway.

The user will require written authorisation from Agrometodos, S.A. for any action exceeding the performance of the contract, and the user may not access, modify or view the settings, structure and files of the servers owned by Agrometodos, S.A., accepting any civil and criminal liability from any incident that may arise in the servers and security systems and as a direct consequence of a negligent or malicious action by them.

Intellectual property of the content housed

Any use contrary to intellectual property law of the services provided by Agrometodos, S.A. is forbidden, particularly:

1. Any use contrary to Spanish law or that infringes the rights of third parties.
2. The publication or broadcasting of any content that, in the opinion of Agrometodos, S.A., is violent, obscene, abusive, illegal, racist, xenophobic or defamatory.
3. Cracks, software serial numbers or any other content that violates intellectual property rights of third parties.
4. The collection and use of personal data of other users without their express consent or contravening the provisions of Regulation (EU) 2016/679, of the European Parliament and of the Council, of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
5. Use of the domain’s e-mail server and of the e-mail addresses to send spam.


The user is fully liable regarding the content of their website, the information transferred and stored, the hypertext links, the claims of third parties and any legal action regarding intellectual property, the rights of third parties, and the protection of minors.

The user is liable regarding the laws and regulations in force, and the rules regarding the operating of the online service, ecommerce, copyrights, the maintaining of public order, and the universal principles of internet use.

The user will compensate Agrometodos, S.A. for any expenses arising from the imputation of Agrometodos, S.A. in any lawsuit in which liability can be attributed to the user, including legal fees and expenses and in the case of a court decision which is not final.

Protection of the information housed

Although Agrometodos, S.A. makes backup copies of the content housed on its servers, it nonetheless accepts no liability for any accidental erasure or loss of data on the part of users. It likewise does not guarantee full restoration of data erased by users, as such data could have been deleted and/or modified during the period since the most recent backup copy.

The services offered, except for specific backup services, do not include recovery of the content stored on the backup copies made by Agrometodos, S.A. when this loss is attributable to the user. In this case, a price in line with the complexity and volume of the recovery will be determined, always with the prior agreement of the user.

The recovery of deleted data is only included in the service price when the loss of content is due to causes attributable to Agrometodos, S.A.

Commercial communications

In application of the Information Society Services and e-Commerce Law. Agrometodos, S.A will not send advertising or promotional communications via email or any other equivalent electronic means of communication unless these have been requested or explicitly authorised by the recipients thereof.

In the case of users with a prior contractual relationship, Agrometodos, S.A is authorised to send commercial communications regarding the products or services of Agrometodos, S.A. that are similar to those initially contracted by the customer.

In all cases, after proving their identity, the user may ask not to be sent any further commercial information through the Customer Service channels.
